1.- Presentation and right to information
INFOEMPRESA EUROPA, S.L takes the protection of privacy and personal data very seriously. As such, your personal information is kept securely and is handled with the utmost care.This data protection policy governs the access to and use of the Website www.infoempresa.es (hereinafter the “Website”), which INFOEMPRESA EUROPA, S.L. (hereinafter “IE”), with registered office at Torre Europa, Paseo de la Castellana, 95, Planta 16, 28046 Madrid, and C.I.F B-86777117, makes available to Internet Users (hereinafter the “Users” or “User”) interested in the services (hereinafter the “Services”) and content (hereinafter the “Content”) hosted by the Website. In accordance with the Organic Law 15/1999 of 13 December, the Protection of Personal Data (hereinafter referred to as the LOPD) and its regulations, IE hereby informs the User of the existence of an automated personal data file, duly registered at the General Register of the Spanish Agency for Data Protection, created by IE and for which it is responsible.
2.- The processing of personal data, purpose of processing and consent
Information is processed differently depending on whether it is personal or non-personal, since both types are found on the Website:
2.1.- Personal data: Users
This is information collected when a user requests a product or service or when a user registers on the Website to access content and services provided by IE, and the Spanish Law on Personal Data [LOPD] applies to this information. User data is collected by IE for the following purposes: (i) the provision of services requested by the User, (ii) the management of possible incidents, (iii) to check and measure the quality of the services offered, (iv) to send general information about the development and functioning of the service or product requested or contracted by the User, (v) to comply with applicable fiscal and accounting duties, (vi) to carry out research into the market and statistics, marketing, and user preferences for services offered, and, unless otherwise indicated, to send commercial communications in accordance with article 21.2 of the Law 34/2002 of 11 July, Information Society Services and E-Commerce, without this entailing any data transfer to third parties. In this respect, we inform you that, in accordance with the LOPD, access to this information by a third party in order to provide a service is not considered a communication of personal data, and there will always be a contract in place to govern this relationship.
2.2.- Data on legal persons and positions in companies
This is information contained in the IE-owned database referring exclusively to legal persons or companies and the positions of people in these companies. Article 2.2 of the Regulation implementing the Spanish Law on Personal Data excludes the processing of data on legal persons from the scope of application of the same. It also excludes files used only for incorporating data on natural persons providing services, which consist only of first name and surname(s), functions or positions held, professional postal address, professional e-mail address, professional telephone number and professional fax number. The Spanish Data Protection Agency [Agencia Española de Protección de Datos] has confirmed its policy on this matter on numerous occasions, indicating that data protection legislation does not apply to cases in which the information being processed on a professional applies only to their position as a trader, industrialist or ship owner; in other words, their business activity. And that is the sole purpose of IE with respect to data on legal persons and positions in companies; any kind of interest in the personal data corresponding to such positions is excluded.
3. – Security measures
IE is bound by its obligation to maintain the secrecy of personal data and to treat it as confidential information, and, to this effect, will implement technical, organizational and security measures in order to prevent its alteration, loss, process or unauthorized access in accordance with the Spanish Organic Law 15/1999 of 13 December, on the Protection of Personal Data, and other applicable legislation. Furthermore, we inform you that all information is protected in our systems and that only employees requiring the information for the purposes of completing a specific task will have access to information of this kind.
4.- Compulsory information provided by the User and veracity of information
The User must provide required information to IE on its Website. IE reserves the right to refuse to provide services to interested parties if this information is not supplied. Additional information may be requested in order to complete the User’s profile so that certain personalized services can be provided. If this information is not provided, IE will not refuse access to its Website, but it will not be able to offer these services to the User. The User guarantees that the information provided is truthful, and is responsible for providing IE with the details of any changes made to this information. The User takes responsibility, in any case, for the veracity of the information provided, with IE reserving the right to exclude from registered services any User which has provided false information, without prejudice to any other legal actions this may incur. It is recommended that necessary precautions be taken for the Protection of Data using security tools. IE is not responsible for the theft, modification or loss of illicit information.
5.- Access, Rectification, Cancellation and Opposition
You are hereby informed that you may, at any moment, withdraw your consent, and exercise your right to access, rectify, cancel or oppose the processing of your personal data from any of those responsible for the files by written notice sent to the email email@example.com, indicating “Exercising rights” in the subject line, or by sending a letter addressed to INFOEMPRESA EUROPA, S.L., Paseo de la Castellana, 95, Torre Europa, Pl. 16º, 28046, Madrid. In both cases, this communication must be accompanied by: a copy of your DNI or document serving as official proof of identity; details of the right you wish to exercise and your request; the telephone number and email address for which you wish to exercise this right; and an address to which notifications can be sent.
